Arbitration, Mediation and ADR: Changing the Landscape for Tech & Innovation Dispute Resolution?
Arbitration and mediation are playing a growing role in technology patent disputes, with the WIPO Arbitration and Mediation Centre recording a 70% rise in IP and technology cases in 2025 and a steady flow of SEP and FRAND matters now referred to ADR rather than fought across multiple courts. With the June 2026 opening of the UPC's Patent Mediation and Arbitration Centre, this is only set to increase.
